§ 9.28.010. Definitions.

  • Whenever used in this chapter, unless the context otherwise requires or specifies, the definitions set forth in this section shall apply:

    A.

    "Disorderly conduct" means any conduct occurring in a public place that interferes with the peaceful conduct of activities normally carried on in or on public places or the conduct occurring constitutes a warranted or justifiable alarm or immediate concern for the safety of persons or property.

    B.

    "Disturbing the peace" means any willful or malicious conduct consisting of loud and/or unusual noises, violent, tumultuous and offensive conduct, threatening, quarreling, challenging to fight or fighting, which said conduct interrupts or interferes with the peace and quiet of any public place, neighborhood or person.

    C.

    "Loitering" means presence and conduct in a public place in which law-abiding people do not usually engage in given the time, place and manner of conduct involved, and the conduct is such that it interferes with the peaceful conduct of activities normally carried on in the public place, or the conduct creates a reasonable alarm or immediate concern for the safety of persons or property.

    D.

    "Public place" means an area to which the public has access and includes publicly-owned buildings, streets, alleys, sidewalks, driveways, parking lots, parks, playgrounds and athletic fields open to the general public, and the doorways and entrances to public buildings and the grounds of such public facilities.

    E.

    "Recklessly skating" means the operation of a skateboard, roller skates, roller blades or scooters upon a sidewalk in such a manner as interferes with or discourages any pedestrian from using a sidewalk in an uninterrupted manner.

    F.

    "Solicit" means to request, either spoken, written or by other means of communication, for an immediate monetary donation or other thing of value from another person regardless of a solicitor's purpose or intended use of the money or other thing of value. This excludes any recognized legitimate organizations.

    G.

    "Trespass" means the going upon any public property after having been warned by any officer of the city not to trespass. A warning not to trespass may either be verbal or written.
