§ 2.36.020. Definitions.

  • As used in this chapter:

    A.

    "Employee" means:

    1.

    Any person employed by the city whose compensation is provided by the city or who is under the direction or control of officers of the city;

    2.

    "Employee" does not include independent contractors or persons rendering professional services to an employer on a fee retainer or contract basis;

    3.

    Probationary employees. The first twelve months of an employee's employment is probationary employment. An employee may be terminated without cause at any time during the probationary period. When circumstances warrant this probationary period may be extended for up to an additional six month period by an employee's department head subject to approval by the mayor;

    4.

    Regular employee. A regular employee is an employee appointed to a year-round position with the city whose position calls for work in excess of one thousand forty hours who has completed the probationary period of employment;

    5.

    Temporary part-time employees. A temporary part-time employee is an employee appointed to a position for a period of time which is less than six months and/or less than one thousand forty hours per year. Temporary part-time employees are not eligible for group insurance, paid annual leave, paid sick leave, holiday pay, Nevada Public Employees Retirement System ("PERS"), or other benefits. If a temporary part-time employee is subsequently appointed as a regular employee, time served as a temporary part-time employee in that same position shall be credited up to a maximum of six months toward the employee's twelve month probationary period.

    B.

    "Officer" means any elected or appointed public official of the city.

    C.

    Full-time service. For the purpose of determining eligibility for step advancements and accrual of benefits, the term "full-time service" means the number of days actually worked on a job, including all absences with pay. Military leave and leave of absence without pay, at the discretion of the mayor, may be credited as full-time service.
