§ 10.80.100. Presumption in reference to violations—Exceptions.

  • In any proceeding for the violation of any of the provisions of this title and Chapter 8.04 or of any of the restrictions imposed by this title and Chapter 8.04, the registration plate or number thereon displayed on the vehicle involved shall be received as prima facie evidence that the registered owner of such vehicle was then operating the same. If, at any hearing or proceeding, the registered owner of such vehicle shall testify, under oath, that he was not operating such vehicle at the time of the alleged violation of this title or Chapter 8.04 and shall submit himself to an examination as to who, at that time, was operating such vehicle and reveal the name of the person, or show that such vehicle was stolen, then the prima facie evidence arising from the registration plate or number thereon shall be overcome and the burden of proof shifted.
