§ 5.16.050. License—Application—Investigation, approval and standards for disapproval by city marshal.

  • Upon receipt of such application, the city marshal shall cause investigation of the applicant's business and moral character to be made as he deems necessary for the protection of the public good. If, as a result of such investigation, the character and business responsibility of the applicant are found to be satisfactory, the city marshal shall endorse on the application his approval, and shall execute a license addressed to the applicant for the carrying on of the business applied for and deliver the license to the applicant. If, however, as a result of such investigation, it appears that said applicant has:

    A.

    Committed any act which if committed by a person already licensed under the provisions of this chapter would be grounds for the revocation of a license under the provisions of this chapter;

    B.

    Committed any act constituting dishonesty or fraud;

    C.

    A bad moral character, intemperate habits, or a bad reputation for truth, honesty and integrity;

    D.

    Been convicted of a felony or any crime involving moral turpitude or illegally using, carrying or possessing a dangerous weapon;

    E.

    Been refused a license or had a license revoked under the provisions of this chapter;

    F.

    While unlicensed, performed any act for which a license is required by the provisions of this chapter; or

    G.

    Knowingly made any false statement in his applica- tion; then, and in that event, the city marshal shall refuse to issue said license.
