§ 21.64.010. Continuance limitations.

  • A lawful use of land or buildings not in conformance with the regulations prescribed by this title existing at the time of the adoption date of the ordinance codified in this title may be continued except as hereinafter provided:

    A.

    If a nonconforming use is discontinued for a period exceeding six months, the use of such land or building thereafter shall be subject to the provisions of this title and full compliance therewith required.

    B.

    The nonconforming use of land or buildings shall not be extended or expanded in any way and shall not be changed except to a use which is conforming, or as may be required to bring such use of land or building into conformity.

    C.

    No building, except a school or church structure which has been damaged or partially destroyed to the extent greater than three times the assessed value, shall be repaired, rebuilt, moved or altered except in conformity with the provisions of this title.

    D.

    Provisions of this chapter shall apply to uses of property, or to building which may become nonconforming by reason of amendment or supplement to this title, or by reason of annexation to the city.
